Terms of Service

These Terms of Service ("Terms") govern your use of Kaiju Calendar (the "Service"). By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.
Kaiju Calendar is operated by EVERNOIR LLC, a Wyoming limited liability company. References to "we", "us", and "our" mean EVERNOIR LLC. "You" means the person or entity using the Service.
1. The Service
Kaiju Calendar lets you connect multiple Google and Microsoft calendar accounts, view their events in a unified interface, and automatically create busy placeholder events on calendars you choose, so that time booked on one calendar is reflected as busy on others. We may add or change features over time. We won't reduce a feature you're paying for without giving you reasonable notice.
2. Your account
You must be at least 16 years old to use Kaiju Calendar. You're responsible for keeping your sign-in email secure, for the accuracy of the information you give us, and for everything that happens under your account. If you suspect unauthorized access, contact us right away.
3. Calendar connections and authority
When you connect a Google or Microsoft account, you authorize us to read your calendars and write events to them on your behalf, within the OAuth scopes you grant. You confirm that you have the authority to grant this access — for example, that the account is yours, or that you're permitted to use it for this purpose under your employer's or other third party's policies.
You are responsible for compliance with policies that apply to your connected accounts. Many employers and organizations have policies governing the use of third-party tools with their email and calendar systems. Kaiju Calendar is a tool you choose to connect; we do not represent that connecting a particular calendar complies with any specific employer policy, enterprise IT rule, contract, or applicable law. You must determine that for yourself before connecting an account.
4. Subscription, trial, and billing
- Free trial: new accounts get a 14-day free trial of the paid plan. No credit card is required to start the trial.
- Pricing: the paid plan is $15 per month, billed monthly, in U.S. dollars. We may change pricing for new subscribers at any time; existing subscribers get at least 30 days' notice before any price increase takes effect.
- After your trial: if you don't subscribe, access to the app is paused — you'll be directed to the billing page and won't be able to use the calendar until you subscribe. Your data and settings are retained while your account exists, so you can pick up where you left off when you subscribe.
- Cancellation: you can cancel at any time from your billing settings. Cancellation takes effect at the end of the current billing period; you keep paid access until then.
- Refunds: we don't offer automatic refunds for time already used, but if something has gone wrong on our end, email hello@kaijuapps.ai and we'll make it right.
- Taxes: prices are exclusive of taxes. Where applicable, sales tax or VAT will be added at checkout.
- Failed payments: if a payment fails, we'll retry and notify you. Persistent non-payment results in your subscription being canceled and access to the app being paused.
5. Acceptable use
You agree not to:
- Use the Service to violate any law or anyone else's rights.
- Connect a calendar account you do not have authority to grant access to.
- Interfere with the Service, attempt to access data that isn't yours, scrape pages or APIs, or probe for vulnerabilities except through coordinated disclosure.
- Resell, sublicense, or expose Kaiju Calendar's functionality as a white-label service, except under a written agreement with us.
- Use the Service to send spam, phish, harass, or otherwise abuse third parties.
- Attempt to circumvent or remove the placeholder marker tags we write on your calendars. Those tags are required for us to clean up after ourselves.
We may suspend or terminate accounts that violate this section. Where the violation is clearly inadvertent, we'll typically reach out before suspending.
6. Your content
The calendar data we read on your behalf belongs to you (or the rightful owner of the underlying account). You grant us a limited license to process that data only as needed to provide the Service — rendering it in your unified view, creating and reconciling busy placeholders, and supporting the operational features described in our Privacy Policy. We don't claim any ownership over your data, and we don't use it to train AI models.
7. Intellectual property
Kaiju Calendar, our website, our software, our brand assets, and all related materials are owned by EVERNOIR LLC and protected by intellectual property laws. We grant you a non-exclusive, non-transferable license to use the Service for as long as your account is in good standing. That license ends when your account ends.
8. Termination
You can stop using the Service and delete your account at any time from your settings. We may suspend or terminate your account if you materially breach these Terms, if we're required to by law, or if we discontinue the Service. If we terminate without cause, we'll refund any prepaid amount for the unused portion of your subscription.
On termination, we run the deletion process described in our Privacy Policy: we remove the busy placeholders we wrote to your calendars, delete the OAuth tokens we stored, and delete your account data from our systems.
9. Disclaimers
The Service is provided "as is" and "as available". We don't warrant that it will be uninterrupted, error-free, or perfectly accurate. We rely on Google's and Microsoft's calendar APIs to work; if those go down or change, the Service may be impaired or unavailable. We don't guarantee that automatic placeholders will always reach the destination provider in real time, and you remain responsible for managing your own time. We expressly disclaim any implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent allowed by law.
10. Limitation of liability
To the fullest extent allowed by law, EVERNOIR LLC will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost calendars, or lost opportunities, even if advised of the possibility. Our total cumulative liability for any claim related to the Service is limited to the greater of (a) the amount you paid us in the twelve months before the claim arose, or (b) one hundred U.S. dollars (US$100). Some jurisdictions don't allow these limitations; in those, our liability is limited to the smallest amount permitted.
11. Indemnification
You agree to indemnify and hold us harmless from any claim, loss, or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Service, your violation of any law, or your infringement of any third party's rights, including claims that you connected a calendar account you weren't authorized to connect.
12. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we'll email anyone with an active account at least 14 days before they take effect. Continued use of the Service after changes take effect means you accept the new Terms.
13. Governing law and disputes
These Terms are governed by the laws of the State of Wyoming, USA, excluding its conflict of laws rules. Any dispute arising from these Terms or the Service must be brought exclusively in the state or federal courts located in Wyoming, and you consent to the personal jurisdiction of those courts. If you're a consumer in the EU, UK, or another region with mandatory consumer protections, nothing in this section overrides rights you have under your local law.
14. Miscellaneous
- If any part of these Terms is found unenforceable, the rest still applies.
- Our failure to enforce a provision isn't a waiver of our right to enforce it later.
- You can't transfer your account or these Terms without our written consent. We can transfer them as part of a merger, acquisition, or sale of assets, on notice to you.
- These Terms, together with our Privacy Policy, are the entire agreement between you and us about the Service.
